Road Verges and Nature Strips

Land adjoining properties, located between the roadway and the property boundary, is generally known as the nature strip in urban areas or road verge in rural areas.

Temora Shire Council's Road Verge and Nature Strip Policy(PDF, 2MB)  outlines requirements for the use, maintenance and management of these areas. The policy covers:

  • Resident responsibilities
  • Council responsibilities
  • Landscaping and maintenance
  • Permitted and prohibited activities
  • Property access infrastructure (i.e. urban  & rural driveways, gutter crossovers/laybacks, gutter ramps)
  • Firewood collection
  • Utility works

Section 138 Approval - Works within the Road Reserve (Local Roads)

Under Section 138 of the Roads Act 1993, approval from the relevant roads authority is required for certain works within a public road reserve.

Approval is required for activities that involve:

  • Erecting a structure or carrying out work in, on or over a public road.
  • Digging up or disturbing the surface of a public road.
  • Removing or interfering with a structure, work or tree on a public road.
  • Pumping water into a public road from any land adjoining the road.
  • Connecting a road (whether public or private) to a classified road.

Works may include, but are not limited to:

  • Construction, modification or replacement of property access infrastructure, including:
    • Driveways (concrete or gravel)
    • Gutter crossovers/laybacks
    • Gutter ramps/foot bridges
    • Rural property accesses
  • Footpath construction
  • Installation, alteration or connection of stormwater/sewer pipes between private property and Council infrastructure
  • Temporary structures or fencing related to building works (e.g. scaffolding, construction fencing)
  • Closure or partial closure of road, nature strip or footpath
  • Clearing of vegetation encroaching on the property boundary fence
  • Native vegetation planting in a rural area

Applications must be submitted a minimum of 2 weeks prior to works commencing.

Section 138 Approval - Works within the Road Reserve (State Roads)

Burley Griffin Way and Goldfields Way are State roads for which Transport for NSW (TfNSW) is the road authority. Any works proposed within these road reserves also require approval from TfNSW.

Council approval must be obtained prior to seeking approval from TfNSW. A copy of Council's approval will be required to be provided to TfNSW as part of their assessment.
